To understand developing economies, we have to understand risk. Law is not arbitrary or rational on a binary; it exists on a scale, and can be arbitrary in parts and rationalistic in others. Capitalists take on risk: legal risk is part of that. So we need to not talk about rationalized law but about risk to capitalists.
